Terms of service
Effective September 3, 2026
This is the agreement between you and Highlander Systems, Inc. (“Highlander,” “we”) for use of highlander.sh, the playground, and the Highlander API. Creating an account or calling the API means you accept it.
The two clauses most people are looking for: you own the video you generate, and credit is prepaid, so there is no invoice you did not choose. The rest is detail.
Your account and keys
You must be at least 13 to hold an account, and at least 18 — or the age of majority where you live — to buy credit. If you are signing up on behalf of a company, you are confirming you have authority to bind it.
An API key authenticates as you. You are responsible for every call made with your keys, including calls you did not intend, and for the credit they spend. Keys are shown once and stored only as hashes, so we cannot recover one for you — but you can revoke a key from your dashboard at any time, and a revoked key stops working immediately. Tell us at contact@highlander.sh if you believe a key has leaked.
Keep one account per person or organisation. Do not share credentials, and do not create accounts to evade a suspension or collect the signup grant more than once.
What you own
You own the output. As between you and Highlander, you hold all rights to the video and audio the service generates for you, and you may use it for any lawful purpose, including commercially. We claim no licence to it beyond what is technically required to generate, store, and deliver it to you.
We do not train on your data. Your prompts, uploads, and outputs are not used to train, fine-tune, or evaluate any model, and are not sold or licensed to anyone.
We will not feature your generations in marketing, on the site, or anywhere else without asking you first.
Two honest limits on that ownership. First, generative models can produce similar output for similar prompts, so we cannot promise your result is unique, and we make no representation that it is copyrightable or free of third-party claims. Second, the model and the service itself remain ours; owning an output does not give you rights in the model, the API, or the site.
What you send us
You keep ownership of your prompts and uploads. You grant us only the licence we need to operate: to store them, process them, and use them to produce your generation.
You warrant that you have the rights to everything you upload, and that using it this way does not infringe anyone’s copyright, trademark, publicity, or privacy rights.
Uploads are stored at public-but-unguessable URLs so the GPU worker can fetch them, and are pruned on a short retention window. They are scratch space, not storage — see the privacy policy for the details.
Acceptable use
Do not use Highlander to create, or attempt to create:
- — Child sexual abuse material, or any sexual content involving minors. This is the one rule with no discussion attached: accounts are terminated and reported.
- — Sexual or intimate imagery of a real, identifiable person without their consent.
- — Content depicting a real person saying or doing something they did not, where it is presented as genuine — impersonation, fabricated statements by public figures, synthetic evidence.
- — Content intended to harass, defame, or threaten a specific person, or to incite violence against anyone.
- — Anything illegal where you are, or anything designed to deceive people for financial gain — fraud, scams, disinformation campaigns.
And do not:
- — Resell or proxy raw API access as if it were your own inference service. Building a product on top of Highlander is fine and encouraged; reselling the endpoint is not.
- — Attempt to extract model weights, reverse-engineer the service, or use outputs to train a competing video model.
- — Circumvent rate limits, concurrency caps, or metering, or probe the service for vulnerabilities without our written permission.
We may suspend or terminate an account that breaks these rules, and we may do so immediately where the violation is serious. Where a suspension is our judgment call rather than a legal necessity, we will tell you why and refund your unused balance.
Credit, pricing, and refunds
Highlander is prepaid. You add credit, and generations draw it down at the published per-second rate on the pricing page. There is no subscription, no seat licence, and no invoice — when the balance reaches zero, generations stop.
- — New accounts receive $1.00 in free credit. It is promotional, has no cash value, and is not refundable.
- — A generation that fails, times out, or is rejected is refunded to your balance automatically. You are not charged for video you did not receive.
- — Purchased credit does not expire and is otherwise non-refundable. If you close your account with a meaningful unused balance, email contact@highlander.sh — we would rather sort it out than keep money for compute we never ran.
- — Prices can change. A change applies to credit bought afterwards; it does not retroactively reprice a balance you already hold.
- — You are responsible for any taxes on your purchase other than taxes on our income.
Charging back a payment you actually authorised, rather than contacting us, will suspend the account.
Availability
Highlander is provided as-is, with no uptime commitment. We would rather say that plainly than imply a guarantee we do not offer: the service runs on a small amount of GPU capacity, and it can be slow, queued, or down. Do not put it on a critical path without your own fallback.
We may change, limit, or discontinue features, and we may impose or adjust rate and concurrency limits. If we discontinue the service outright, we will give account holders notice and refund unused purchased credit.
To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
Liability
To the fullest extent the law allows, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or lost data.
Our total liability arising out of these terms is capped at the greater of the fees you paid us in the twelve months before the claim, or $100.
You agree to indemnify us against third-party claims arising from your use of the service, the content you upload, or the content you generate and publish — but not from our own breach of these terms.
Some jurisdictions do not allow these limits. Where that is true, they apply to the extent permitted and no further, and nothing here limits liability for fraud or anything else that cannot lawfully be limited.
Termination
You can stop using Highlander and delete your account at any time. We can suspend or terminate an account for breach of these terms, for non-payment, or where we are legally required to.
On termination your keys stop working and your generation history and uploads are deleted. The ownership, liability, indemnity, and governing-law sections survive.
Governing law
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in Santa Clara County, California, and both parties consent to jurisdiction there.
If a provision is held unenforceable, the rest stays in force. Our failure to enforce a provision is not a waiver of it. These terms, together with the privacy policy, are the entire agreement between us.
Changes
We may update these terms. For material changes we will update the effective date above and email account holders before they take effect. Continuing to use Highlander afterwards means you accept the new version; if you do not, stop using the service and email contact@highlander.sh about your unused balance.
